well, BBC News 24 said that the reason that they decided to sue was that the statute of limitations says that the lawsuit must be brought within 3 years. and so they just got inside the deadline, incase any evidence comes up, not to actually start proceedings.

Did that make sense? I'm not sure I wrote that very well.
